This is the privacy notice of FELD ENTERTAINMENT, INC. (FEI; we; us/our) (Privacy Notice). This Privacy Notice provides information about the personal data which we collect and process from users of our websites (the Websites) and other services, such as the sale of tickets for our shows, and our online competitions (Competitions) (collectively: the Services). We process your data so that you can use these Services.

Your privacy is important to us. FEI will handle your data securely and ensure that any processing of your data complies with the applicable laws and regulations (including EU Regulation 2016/679, the General Data Protection Regulation (GDPR)).

We recommend that you read this Privacy Notice carefully.

This Privacy Notice describes which of your personal data FEI processes for each Service to deliver this specific Service and what this means exactly. The Privacy Notice consists of a general portion and a Services portion. In the general portion, we will provide information about who processes your personal data and what your rights are. In the Services portion, we will indicate for each Service the way in which we process your personal data, how long we retain your personal data and whether we transmit your personal data to countries outside the European Economic Area (the EEA).

  1. Changes to the Privacy Notice

We may change this Privacy Notice because of, for example, statutory or technological changes. We will inform you of important changes to the Privacy Notice. Any changes to this Privacy Notice will be posted on the Websites, together with a summary of the key changes. You can always consult our Websites for the most recent version of this Privacy Notice.

This Privacy Notice was amended most recently on February 5, 2024.

The latest amendments have been implemented to update FEI’s processing activities in respect to the Websites and align the information provision across the various Websites.

“Personal data” are data that identify you as a person or enable us to identify you as a person (such as your name, email, home address and telephone number).

  1. Links to third-party websites

The Websites may contain links to third-party websites which are not owned or managed by FEI. We only make these links available to help you, and the mention of a link on the Websites does not imply that FEI endorses the content of the linked website. If you disclose personal data through such a third‑party website, your transaction will go through this third-party website (and not the Websites). The personal data you disclose will be collected by that third party and will be subject to its privacy notice. We are not responsible for the way in which third parties process your personal data. We strongly recommend that you read those websites’ privacy notices.

  1. Use of our Websites by children

FEI’s Websites are not intended for persons under the age of eighteen (18). Thus, we ask that children not disclose personal data to us.  If you, as the legal representative, learn, however, that your child has disclosed personal data to FEI without your consent (for example, by indicating a wrong age), please contact us through privacyeu@feldinc.com.

If FEI determines that it has stored personal data from a child younger than 18 without consent by the child’s legal representative, we will delete this information immediately.

Our Terms and Conditions of Use include additional information about the use of this Website by minors.

  1. Your rights and exercising these

You have the following rights, which you can exercise at any time:

    • You can ask us to allow you to access your personal data.
    • You can ask us to correct your personal data. We will grant this request if the personal data we process from you is inaccurate or incomplete, bearing in mind the purposes of the data processing.
    • You can object to further processing by us for reasons relating to your specific situation. We will grant this request, unless we have compelling legitimate grounds for continuing processing which outweigh your interests, rights and freedoms, or which relate to the establishment, exercise or substantiation of a legal claim.
    • You can object to the processing of your personal data for “direct marketing” purposes. If you exercise this right, we will comply with it and no longer process your personal data for “direct marketing” purposes.
    • You can ask us to limit the processing of your personal data. We will grant this request if:
      • you dispute the accuracy of the personal data, specifically, during the period which we need to check the accuracy of the personal data;
      • we are processing your data in an unlawful manner, but you do not want us to delete your data;
      • we no longer need your personal data for our processing purposes, but you need the data to establish, exercise or substantiate a legal claim; or
      • you object to the processing by us, in anticipation of our response or an answer to the question whether our legitimate interests outweigh yours.

If we limit the data processing consistent with the foregoing, we will inform you before we discontinue the limitation of this.

    • You can ask us to delete your personal data. We will grant this request if:
      • we no longer need the data for the processing purposes;
      • you withdraw your consent;
      • you object to the processing of your personal data, and there are no compelling legitimate reasons for us not to delete the data;
      • we have processed your personal data in an unlawful manner; or
      • we must erase the data to fulfil a legal obligation which we have under the law of the European Union or one of its Member States.
    • You can ask us to furnish a copy of the personal data we have processed from you or ask us to provide this data to a third party. You are only entitled to do this insofar as this pertains to personal data you yourself have disclosed to us and which we process based on your consent, or because this is necessary to perform an agreement between you and us, or to take measures at your request before an agreement between you and us is concluded.

If we process your data pursuant on the legal basis of consent, you may withdraw this consent at any time. Withdrawal of your consent does not prejudice the lawfulness of the processing of your personal data based on consent before the withdrawal.

If you wish to exercise one or more of the above rights, you can send a request to privacyeu@feldinc.com. We will respond to your request without undue delay, but in any event within thirty (30) business days. We reserve the right to extend this period by two (2) months in accordance with the GDPR.

  1. The transfer of your personal data

We will share your personal data as follows:

    • We share your data within the FEI Group of Companies. Insofar as we share your personal data within the FEI Group, we make sure that your personal data is subject to the same level of security within all of the FEI Group’s companies.
    • We share your data with certain third parties or government agencies, insofar as FEI is required to do this under applicable laws, regulations or government rules, or if this is necessary to prevent, investigate or prosecute criminal offences or to assert or represent our rights or interests.
    • Where this is necessary to perform the Services, we will share your data with external service providers on the instructions and under the responsibility of FEI. Such service providers are considered “processors.” We share your data with the following categories of processors:
      • Agencies;
      • Ad platforms;
      • Marketing and communication services providers; and
      • Promotors of our shows.

Your personal data will remain under FEI’s control in such cases. These external service providers will always be subject to FEI’s written instructions, including certain security obligations.

We have opted to not include a list of all named external service providers. This is because we are a large, globally operating company that works with a large number of external service providers, varying per country. Including all these service providers in this Privacy Notice would not contribute to its clarity. We also regularly change suppliers. It would therefore be a large administrative burden to keep an exhaustive list of external service providers up to date. We would also have to update you each time we add or remove a recipient, which we feel would be burdensome for you. We therefore believe that giving you a list of categories of external service providers receiving your personal data is more transparent and user friendly than including a list of all actual service providers separated per country.

We do not store your personal data outside the EEA or transfer it to parties outside the EEA.

  1. Complaints

If you have complaints about the way FEI is processing your personal data or if you would like to respond to this Privacy Notice, please contact us through privacyeu@feldinc.com. Your complaint/response will be investigated, and you will receive an answer within one (1) month after the investigation is completed (but we may extend this period with two (2) months), along with information about any follow-up actions required in connection with your complaint.

You also have the right to file a complaint with a supervisory authority about the way FEI processes your personal data, in particular in the European Union member state where you are habitually resident, where you work or where an alleged infringement of the data protection laws has taken place. Subscriptions and communications
On some of our Websites, you can register as a Feld Entertainment VIP Member / Preferred Customer and subscribe to our newsletter. As such a Member / Customer, you can take advantage of such benefits as discounts on tickets for events organised by FEI and special offers, and the latest news about events organised by FEI. To become a Feld Entertainment VIP Member / Preferred Customer, you must furnish some data, including your name, e-mail address, street address and town/city. If you do not provide the data requested in the mandatory fields, you will not be able to register.

    • providing you with news/updates/valuable information about our shows;
    • creating look-a-like audiences for marketing purposes, including targeting audiences that may be interested in FEI’s shows and products.

(c) What is the legal basis for the processing of your personal data?

We require a legal basis to process your personal data. We process your data on the following legal bases:

Contact
Personal data we collect if you send us an e-mail is processed by us on the basis that this is necessary for our legitimate interest. This interest is that we want to be able to respond to your message or questions. We have undertaken a balancing test between our interest and your interests. Given that you have contacted us, we conclude that your interests do not outweigh our interest to be able to respond to your message.

Subscriptions
Personal data that we collect pursuant to your registration for Feld Entertainment VIP Membership / Preferred Customer is processed by us on the basis of your Consent.

Communications
If we collect personal data following your subscription to our newsletters, we process this data based on your Consent (Article 6(1)(a) GDPR).

(d) How long do we retain your personal data?

We do not keep your personal data any longer than is legally permissible, and we will delete your data if it is no longer necessary for the above‑mentioned purposes. For each processing activity, the retention period for your data is indicated below.

Contact
Personal data we collect if you contact us will generally be deleted after two (2) years, unless there are circumstances that require us to retain the data longer, for example if we are obliged to do so by law or to preserve our rights or those of our employees.

Cookies
For cookies, the retention period will depend on the type of cookie and the cookie settings of your browser. Information on the cookie retention period is available in your browser.

Subscriptions
We do not keep your personal data any longer than is legally permissible, and we will delete your data if they are no longer necessary for the above‑mentioned purposes, unless there are circumstances that require us to retain the data longer, for example if we are obliged to do so by law or to preserve our rights or those of our employees.

Your personal data will be retained during your Feld Entertainment VIP Membership / Preferred Customer, until you indicate to us that you no longer wish to be a VIP Member / Preferred Customer. We will verify by e-mail once every five years if you still want to be a Feld Entertainment VIP / Preferred Customer.

Communications
Your personal data will be retained until you indicate to us that you no longer wish to receive our newsletter, or if you have not opened a FEI newsletter for more than five (5) years.

ONLINE COMPETITIONS

(a) How do we collect your personal data?

We will collect your personal data if you participate in Competitions, such as our Disney On Ice Competitions.

(b) For which purposes do we process your personal data?

We collect your personal data for the following purposes:

    • informing you about your registration;
    • facilitating the operation of the relevant competition; and
    • contacting you if you win.

You should carefully read the rules of each Competition in which you participate through the Website or Facebook, because they contain important, additional information about how FEI uses your personal data for that specific Competition. Insofar as such rules conflict with this Privacy Notice, the specific rules of the Competition will take precedence over this Privacy Notice.

(c) What is the legal basis for the processing of your personal data?

We require a legal basis to process your personal data. Personal data we collect pursuant to your participation in our Competitions is collected because it is necessary for the performance of our agreement with you (Article 6(1)(b) GDPR).

The provision of your personal data is a requirement necessary to enter into the Competition. If you do not provide your personal data, you cannot participate in our Competitions.

(d) How long do we retain your personal data?

We will retain your personal data no longer than four (4) months after the end of the Competition, unless there are circumstances that require us to retain the personal data longer, for example if we are obliged to do so by law or to preserve our rights or those of our employees, or if we have collected your personal data for another purpose as well and we need to retain your personal data for that purpose (for example if you have also subscribed to our newsletter).

SALES OF TICKETS FOR OUR SHOW

(a) How do we collect your personal data and which categories of data do we collect?

We collect your personal data if you purchase a ticket for one of our shows. We receive your personal data from our ticketing partners. We collect the following personal data:

    • name and surname;
    • e-mail address;
    • organization;
    • address;
    • country;
    • zip code;
    • whether you have children or not; and
    • information regarding your order, namely: date of order; the show you ordered tickets for; location of the show; date and time of the show; number of tickets; seats; and whether or not you ordered a family ticket.

(b) For which purposes do we process your personal data?

We collect your personal data for the following purposes:

    • providing you your ticket; and
    • contacting you with information about the show.

(c) What is the legal basis for the processing of your personal data?

We require a legal basis to process your personal data. Personal data that we collect if you purchase a ticket for one of our shows are collected because they are necessary for the performance of our agreement with you (Article 6(1)(b) GDPR).

The provision of your personal data is a requirement necessary to enter into an agreement with us. If you do not provide your personal data, you cannot purchase tickets to our shows.

(d) How long do we retain your personal data?

We will retain your personal data no longer than five (5) years after you purchased a ticket, unless there are circumstances that require us to retain the data longer, for example if we are obliged to do so by law or to preserve our rights or those of our employees.
